AT THE TIME OF BOOKING, YOU MUST AGREE TO HONOR AND ABIDE BY THE TERMS AND CONDITIONS LAID DOWN BY NEWQUAY WATER SPORTS CENTRE AND MUST MAKE ALL THE PARTICIPANTS IN YOUR PARTY AWARE OF THESE TERMS AND CONDITIONS.

TERMS & CONDITIONS - FOR ACTIVITY CUSTOMERS

BOOKING AGREEMENT – To secure your booking, the full amount due will be requested at the time of booking. Within the full amount of your booking is a 50% non-refundable deposit. The full payment of the booking will secure the date and time and activity for the number of participants that you require.

We/NWSC accept bookings either verbally, by email, online through our booking system or written letter.
Bookings are accepted when We/NWSC receives your non-refundable deposit or full payment. We/NWSC reserves the right to make exceptions to the above where instances dictate.

Bookings are confirmed when we/NWSC receives your full payment. A booking confirmation will be sent to the booker via email or post or SMS direct asap.

BOOKER PLEASE BE AWARE – PARTICIPANTS – ALL participants must be made aware by the person booking the trip that all outdoor adventurous activities, carries a degree of risk. Even though Newquay Water Sports Centre/ NWSC has tried to minimise these risks, there is still a chance that participants may fall into cold, turbulent water that is fast flowing. Participants will only be accepted on the understanding that they are aware of these risks and wish to participate of their own free will.
On signing the ‘Trip Reservation’ or Company paper, or receiving your Booking Receipt Confirmation, you agree to honour and abide by the terms and conditions laid down by Newquay Water Sports Centre/ NWSC and have made all the participants in your party aware of these terms and conditions.

ARRIVING LATE TO YOUR BOOKING  Please don’t be late. If travelling prepare for any delays or issues with traffic and parking in peak season. Details on parking etc can be found on your booking confirmation. Get familiar with where we are based and where we are meeting for your booked activity.

NON-PRIVATE SESSIONS – If you are 10 mins or more late from your allocated arrivial time you will not be able to take part in the activity. Please be considerate and respect the instructors and other customers attending the same session. We cannot delay, postpone, alter, refund, credit, exchange sessions or rebook due to late arrivals for whatever reason.

PRIVATE SESSIONS – If you have booked a private session, call ahead if you are going to be late. Lateness will eat into your booked timeslot shortening the session by the amount of time late. If you are 20 mins late or more, you will not be able to take part in the activity. Please be considerate and respect the instructors and other customers at the centre. We cannot delay, postpone, alter, refund, credit, exchange sessions or rebook due to late arrivals for whatever reason.

HEALTH & SAFETY – DOCUMENTS – ACTIVITY CUSTOMERS – All participants of our activities are required to complete our risk acknowledgement activity form. Which is included in your booking under, “view required documents”. As the booker you are required to ensure all participants are given access/ emailed a link to view and complete this. For adults its one form each and for minors (under 18’s) a parent or guardian must fill out the form with their (the adults) details and then added in the minors section each minor under their guardianship. One form can contain 1 adult and 6 minors where required. These must be completed pre arrivial or we will not be able to take activity customers on the activity booked.

By paying for your booking, you are confirming that all persons are the right age to take part in the activity, fit and healthy and can swim.

Included in the cost of the activity is all the necessary PPE and safety equipment. A fully trained and qualified, professional guide will ensure your safety throughout the activity session.

In the interests of health and safety, alcohol and intoxicated persons should be left at home. If a participant is intoxicated, they will not be permitted to take part along with no credits, refunds, or rescheduling.

We endeavour to run the safest, most fun trips possible, therefore age restrictions are in place. Please ask when making your booking and read the description for the activity that you are booking on too.
N.B Newquay Water Sports Centre (NWSC) reserve the right to change the venue of any trip if water levels are too low or too high on the day. We also reserve the right to change to an alternative activity, cancel or postpone any trip/activity due to inclement weather where we/NWSC deem the activity would be unsafe to take place.

If the water levels or weather conditions on the day of the activity are incompatible towards a safe adventure. We/NWSC reserves the right to change the venue, change to an alternative activity, to postpone or cancel any trip.

EQUIPMENT – For activity customers and not our hire customers – Included in the cost of the activity is all the necessary PPE and activity equipment necessary.

  • Water Activities: You are expected to bring old trainers, something to wear under a wetsuit, a towel and a change of warm clothes
  • Land Activities: You are expected to bring sturdy, outdoor footwear (no open toe footwear) and appropriate clothing for changeable weather, including waterproofs

CANCELLATIONS – All cancellations must be advised in writing and signed by the person who originally made the booking with NWSC to info@newquaywatersportscentre.co.uk Cancellations are accepted as from the date NWSC receives the written confirmation of cancellation. Any form of cancellations incurs the following charges: – 1. Date of booking being taken to 15 working days prior to the activity/trip/event taking place – client will lose their non-refundable deposit (50% of the full amount as stated above). 2. Within 14 working days of the activity/trip/event, taking place – client will be charged the full amount of the trip. 3. If the booking is made within 14 days of the event, the full payment is required to secure the booking and is non-refundable or transferable.

AMENDMENTS – Final numbers of participants must be confirmed by email to info@newquaywatersportscentre.co.uk no later than 3 weeks prior to the trip. Failure to do this will result in the client being charged for the full number of persons booked. Any discounts previously quoted or booked maybe lost or adjusted due to the final number of participants booked.

GIFT VOUCHERS – All gift vouchers are non-transferable or refundable. Expiry dates are shown on the voucher and when they expire, they are automatically expired from our booking system and cannot be retrieved. You can extend a gift vouchers date by 6 months if you contact us before its expiry date, quoting your details and voucher code (Vouchers can only be extended for 6 months once using this procedure) this is for £5 admin fee per voucher. Extensions are not permitted on credit notes/gift vouchers where an activity has been cancelled, rescheduled, or postponed.

INSURANCE – Even though Newquay Water Sports Centre/ NWSC carries full Public Liability Insurance, it is strongly suggested that participants carry their own personal accident policy that covers them for the activity they are undertaking. This should include white-water rafting, surfing, coasteering, climbing, mountain biking and kayaking etc. Personal accident policies are usually available from your own insurance broker. Participants should also take out holiday insurance for any unforeseen circumstances with regards to cancellations etc.

NATURAL DISASTERS & PANDEMICS – “As per our policy for ‘Natural Disasters’ no refunds will be offered if cancellation is due to an unforeseeable natural disaster or ‘act of God’ as quite obviously this is out of our control. Specifically, in no event will we be liable for any loss or damage whatsoever without limitation arising from the contracting of COVID-19 Corona virus or any other illness whilst engaging in any of our activities and/or sessions. By booking you are agreeing to this, and you thereby release and discharge us from any claims and liabilities against us due to any COVID-19 Corona virus circumstance which might occur. Only Customer bookings effected by the UK Government imposing a regional or national lockdown, in which case a customer cannot travel due to them or us being lockdown (not ill health) – We will of course honour your booking going forward and will offer you a unique credit code / gift voucher which will enable you to re-book for any of our sessions in the future. This will be valid for 1 year from date of the cancelled session. This voucher / code will then be subject to our “Gift Voucher” terms and conditions policy, found above.”

EXCLUSIVE AGENT ACCOUNTS – All exclusive agent office invoices and outstanding balances must be paid no later than 2 weeks before the date of the trip. Within two weeks of the activity NWSC will charge all outstanding accounts at 3% interest for every seven days thereafter. VAT is charged at the standard rate on all invoices.

PRINT & WEBSITE – ADVERTISEMENTS AND COMPANY DOCUMENTS – Newquay Water Sports Centre/ NWSC reserve the right to make alterations to website details, brochure details, and any other company documents, before and after any booking has been received and confirmed. These changes will be minor, and in most cases, we will inform you at the earliest opportunity if this may affect you.
